外聘船员合同书external crew contract
甲方：（以下简称甲方）

甲乙双方本着平等，自愿的原则，签订本合同，双方同意并承诺共同遵守以下合同条款：
A and B signed this contract based on the principle of equality and voluntary，both agree and promise to obey the following terms of the contract
一，工作内容和合同期限job duties and contract period
1.甲方根据工作需要安排船员乙方轮 担任职务，合同期限为 个月，自上船之日起计算。合同期满，双方未办理合同终止或者续订手续的，视为本合同自动延续，任何一方都有权利通知对方终止合同。但合同届满时或延续期间，如船舶在国外或者航行中或者不方便离船的港口，则合同自动延续至船舶到达可离船的港口之日为止。A appoint BasonMV:The contract period is or renewal the contract when the contract expired, regard as the contract continue automatically, each side have the right to notice the other side to end the contract.but ,if when the contract expired, the ship or the crew or the port is inconvenient ,the contract can be continued until the convenient port.2乙方因伤，病并经医生证明，或者由于不可抗力原因，造成乙方不能继续在船工作的，合同自行终止。合同期内，如发生卖船，更换船东等，甲方可以提前终止合同，乙方的遣返费由甲方负担。Bcan not work on board due to injury or illne(should be proofed by doctor)or majeure force, the contract end automatically.A end the contract and offer B repatriation fee when exchange ship owner or sell the ship during the crew contract period.3.乙方在合同期内如遇配偶或者亲属举丧之事，在征得甲方同意后可以安排下船。乙方因为个人原因，无正当理由下船的，其下船的船差费，代理费等由乙方自负。由此造成甲方损失及更换船员费用增加的，乙方负责赔偿。B can get off when meet his relatives death and A agree to exchange crew during the contract period.but B get off the ship without reasonable excuse by himself ,B have to pay the agent fee and other payment.If this cause A economic lo, B should pay for the lo.二．工资福利待遇 salary and benefits
1.乙方在船工作期间，月工资标准是美元（包括基薪，固定加班费，养老保险，医疗保险，工伤保险，生育保险）。乙方按照甲方的规定领取外派工资和相关津贴，甲方按照国家规定的缴费基数即平均工资的三倍缴纳养老保险，医疗保险。失业保险，工伤保险，生育保险。如不满一个月，按照实际天数/当月天数*月工资计算，上下船工资结算时间为上船当日起至下船前一日止（以交接单日期为准）。B works onboard，the salary is
One month(include base salary，fixed overtime，endowment insurance，medical insurance，injury insurance，maternity insurance)，B get the salary regularly，A pay the endowment insurance，medical insurance，injury insurance，maternity insurance according to the national regulation。If shorter than one month，calculate as ：actual days/ days of the month * month salary, the date calculated from the first day onboard to the last two day get off on the pa-on sheet。
2.甲方根据乙方提供的详细汇款账号，每月以银行汇款方式于15日—20日之间结清上月工资，下船工资的结算时间为收到正常下船差费，交接清单后一并结清。A pay off last month salary during the 15th---20thof the month according to the detailed bank account number which B send to the company.when crew get off the ship ,the salary of departure should be pay off when receive the normal ship sent fee invoice and pa-on sheet
3.甲方提供乙方在船生活费为每日4.0美金。提供在船期间相应劳动保护补助及医疗补助。A offer B living cost 4.0USD one day on board，offer labor protection and medical subsidy
4.乙方正常上下船的费用由甲方承担，但乙方必须按照甲方的规定的标准执行，超出部分非特殊情况下甲方不予承担，未完成合同提前下船的差费乙方承担。A offer the normal ship sent fee for B according to the company regulation，if B don’t have reasonable excuse ,the beyond part should be paied by B himself.get off the ship before the ending of the contract ,Bpay all the bill.5.合同期内，甲方负责为乙方提供风险保障：如死亡，受伤，生病等情况，甲方根据P&I协会条款或者保险公司条款为乙方提供保障，但以下情况除外：A offer risk guarantee for death，injury，illne etc according to P&I aociation，but except：
（1）并非在船上是发生的受伤，死亡 injury or death not on board
（2）受伤或者患病是由于乙方的故意行为，违章，酗酒或者不正当举止所致 injury or illne caused by intentional action，peccancy intemperance or other incorrect action
（3）签订合同时故意隐瞒疾病等 hide the truth when sign the contract
6.乙方在工作期间享受甲方的各项奖励，自修费，劳务费等地分配。
B have the right to share the reward，self-maintenance fee，labor fee ect
三，双方的权利和义务both sides’ right and duty
1.乙方应保证身体健康，保证持有有效的主管机关签发的有效的船员服务薄，基本安全培训合格证，海员证，职务证书以及公约要求的其他技术证书。根据需要乙方应接受甲方的ISM 培训，遵守甲方的SMS 体系文件的规定。B should be ensure not only healthy and have valid crew service book，the basic safety training certificate，seamen’s certificate，post certificate and other technical certificate required by international conventions.B should receive the ISM training and obey the SMSregulations made by the company.2.甲方负责为乙方办理外籍证书及出境手续，正常情况下所发生的费用由乙方自负，在船工作满个月之后所发生的费用，酌情报销。Aarrange the foreign certificate and exit formalities for B，B pay all the bill，can apply for some refund
3.根据配员要求，乙方需要值班的，船长要求必须会操作使用船上的通导设备。
If discharge required，B should can operate the communication equipments on board
4.乙方在合同期内，应忠于职守，遵纪守法，尽职尽责，如有下列行为者，甲方有权终止合同，乙方除自行承担后果外，对甲方造成的损失应负赔偿责任，甲方亦有权根据乙方行为后果的严重程度给予相应的经济处罚：B should be on duty and responsible for his act onboard，if B do the following action，A have rights to end the contract at once and ask for compensation，and have rights to punish B with economic methods
（1）乙方工作失职，给船舶安全性或者正常航行造成危险或者损失的 B neglect his duty cause danger or lo
（2）乙方不遵守甲方的管理制度或者不服从公司管理的B break company rules or management regulations
（3）乙方漏船或者擅自离船的 Bget off the ship without permiion
（4）乙方参与盗窃，走私，偷渡，贩毒，色情等活动的 B join the following act ：steal Smuggle，stowaway，drug trade，eroticism ect
（5）乙方不遵守所在港国家法令等被追究地方责任给甲方造成损失的B break port station rules，is punished by the state，caused problems or lo
（6）乙方私自与ITF 及其他国际公会组织接触的B contact with ITF or other international aociations privately
（7）其他严重违法违纪情形other seriousillegal acts
四，违约责任 defaultresponsibilities
合同履行期间任何一方违约将导致合同终止，违约方应向对方支付合同期内月工资总额的10%的违约金。each side break the contract lead to the ending of the contract and the breaker should pay 10% salary of one month as liquidate damages
五，争议解决dispute resolution
合同履行期间内，双方如有争议，应协商解决，如协商不成，双方同意由甲方所在地的法院解决。If there is a dispute between A and B，should be consulted，if the argument can not be diolved，apply for the court where A located in
六，签约生效 contract come into force
本合同双方共同签订于本合同一式两份，甲乙各执一份，合同自签订之日起生效。The crew contract signed in the city of，one for each side.The contract come into force from the signed date
