第一章 总则
第一条 为了加强历史文化名城、名镇、名村的保护与管理，继承中华民族优秀历史文化遗产，制定本条
例。
第二条 历史文化名城、名镇、名村的申报、批准、规划、保护，适用本条例。
第三条 历史文化名城、名镇、名村的保护应当遵
consistent with the principle of scientific planning and strict protection, so as to maintain and continue their traditional patterns and historical styles and features, safeguard the authenticity and integrity of historical and cultural heritage, inherit and carry forward the outstanding historical and cultural heritage of the Chinese nation and correctly handle the relationship between the economic and social development and the historical and cultural heritage protection.Article 4 The state shall give neceary monetary support for the protection of famous historical and cultural cities, towns and villages.The local people's governments at or above the county level where any famous historical and cultural cities, towns and villages are located shall arrange protection funds based on their own actualities, and incorporate the protection funds into the treasury budget of the corresponding levels.The state shall encourage enterprises, public institutions, social groups and individuals to participate in the protection of famous historical and cultural cities, towns and villages.Article 5 The construction administrative department under the State Council shall, jointly with the cultural heritage administrative department under the State Council, be responsible for protecting, supervising and administering the famous historical and cultural cities, towns and villages acro the country.The local people's governments at various levels shall be responsible for protecting, supervising and administering the famous historical and cultural cities, towns and villages within their respective administrative areas.循科学规划、严格保护的原则，保持和延续其传统格局和历史风貌，维护历史文化遗产的真实性和完整性，继承和弘扬中华民族优秀传统文化，正确处理经济社会发展和历史文化遗产保护的关系。
第四条 国家对历史文化名城、名镇、名村的保护给予必要的资金支持。
历史文化名城、名镇、名村所在地的县级以上地方人民政府，根据本地实际情况安排保护资金，列入本级财政预算。
国家鼓励企业、事业单位、社会团体和个人参与历史文化名城、名镇、名村的保护。（相关资料:相关论文1篇）
第五条 国务院建设主管部门会同国务院文物主管部门负责全国历史文化名城、名镇、名村的保护和监督管理工作。
地方各级人民政府负责本行政区域历史文化名城、名镇、名村的保护和监督管理工作。
Article 6 The people's governments at or above the county level and their relevant departments shall commend and give awards to those entities and individuals that have made outstanding achievements in the protection of famous historical and cultural cities, towns and villages according to the relevant provisions of the state.Chapter II Application and Approval Article 7 A city, town or village meeting the following conditions may apply for being a famous historical and cultural city, town or village: 1.The cultural relics preserved there are particularly rich;2.The historical buildings there are clustered;3.The traditional pattern and the historical style and features are preserved there;and 4.It has ever been a political, economic, cultural, transportation center or an important military place in the history, or has gone through any important historical events, or its traditional industries or major projects built in the history have ever produced important influences on the development of the local place, or it is able to collectively reflect the cultural or ethnical features of local buildings.For the application for being a famous historical and cultural city, there shall be two or more historical and cultural blocks within the protection scope of the famous historical and cultural
第六条 县级以上人民政府及其有关部门对在历史文化名城、名镇、名村保护工作中做出突出贡献的单位
和个人，按照国家有关规定给予表彰和奖励。
第二章 申报与批准
第七条 具备下列条件的城市、镇、村庄，可以申
报历史文化名城、名镇、名村：
（一）保存文物特别丰富；
（二）历史建筑集中成片；
（三）保留着传统格局和历史风貌；
（四）历史上曾经作为政治、经济、文化、交通中心或者军事要地，或者发生过重要历史事件，或者其传统产业、历史上建设的重大工程对本地区的发展产生过重要 影响，或者能够集中反映本地区建筑的文化特色、民族
特色。

第八条 申报历史文化名城、名镇、名村，应当提 交所申报的历史文化名城、名镇、名村的下列材料：
（一）历史沿革、地方特色和历史文化价值的说明；
（二）传统格局和历史风貌的现状；
（三）保护范围；
（四）不可移动文物、历史建筑、历史文化街区的清单；
（五）保护工作情况、保护目标和保护要求。
第九条 申报历史文化名城，由省、自治区、直辖市人民政府提出申请，经国务院建设主管部门会同国务院文物主管部门组织有关部门、专家进行论证，提出审查意见，报国务院批准公布。
申报历史文化名镇、名村，由所在地县级人民政府提出申请，经省、自治区、直辖市人民政府确定的保护主管部门会同同级文物主管部门组织有关部门、专家进行论证，提出审查意见，报省、自治区、直辖市人民政府批
department determined by the people's government of the province, autonomous region or municipality directly under the Central Government shall, jointly with the cultural heritage administrative department at the same level, organize relevant departments and experts for demonstration, put forward the examination opinions and submit them to the people's government of the province, autonomous region or municipality directly under the Central Government for approval and announcement.Article 10 For any city that meets the conditions provided for in Article 7 of this Regulation but has not applied for being a famous historical and cultural city, the construction administrative department under the State Council may, jointly with the cultural heritage administrative department under the State Council, bring forward a suggestion to the people's government of the local province or autonomous region that it should make an application;or may directly bring forward a suggestion to the State Council on determining this city as a famous historical and cultural city if the local provincial people's government still fails to make application.For a town or village that meets the conditions provided for in Article 7 of this Regulation but has not applied for being a famous historical and cultural town or village, the protection administrative department determined by the people's government of the province, autonomous region or municipality directly under the Central Government may, jointly with the cultural heritage administrative department at the same level, bring forward a suggestion to the people's government of the county where the town or village is located that it should make an application;or may directly bring forward a suggestion to the people's government of the province, autonomous region or municipality directly under the Central Government on

对符合本条例第七条规定的条件而没有申报历史文化名镇、名村的镇、村庄，省、自治区、直辖市人民政府确定的保护主管部门会同同级文物主管部门可以向该镇、村庄所在地的县级人民政府提出申报建议；仍不申报的，可以直接向省、自治区、直辖市人民政府提出确定该镇、村庄为历史文化名镇、名村的建议。
determining this town or village as a famous historical and cultural town or village if the people's government of the local county still fails to make application.Article 11 The construction administrative department under the State Council may, jointly with the cultural heritage administrative department under the State Council, select some famous historical and cultural towns and villages with important historical, cultural and scientific value from the famous historical and cultural towns and villages that have been approved and announced strictly according to the relevant evaluation standards of the state, and upon the experts' demonstration, determine them as China's famous historical and cultural towns and villages.Article 12 For the famous historical and cultural cities, towns and villages that have been approved and announced, if their historical and cultural value is seriously impaired due to inadequate protection, the approval departments thereof shall incorporate them into the endangered list, announce the endangered list, and order the people's governments of the local cities and counties to take remedial measures within a time limit to prevent deterioration of conditions, improve the protection system and reinforce the protective work.Chapter III Protection Planning Article 13 After a famous historical and cultural city has been approved and announced, the people's government thereof shall organize the formulation of protection planning for the famous historical and cultural city.第十一条 国务院建设主管部门会同国务院文物主管部门可以在已批准公布的历史文化名镇、名村中，严格按照国家有关评价标准，选择具有重大历史、艺术、科学价值的历史文化名镇、名村，经专家论证，确定为
中国历史文化名镇、名村。
第十二条 已批准公布的历史文化名城、名镇、名村，因保护不力使其历史文化价值受到严重影响的，批准机关应当将其列入濒危名单，予以公布，并责成所在地城市、县人民政府限期采取补救措施，防止情况继续恶化，并完善保护制度，加强保护工作。
第三章 保护规划
第十三条 历史文化名城批准公布后，历史文化名城人民政府应当组织编制历史文化名城保护规划。
历史文化名镇、名村批准公布后，所在地县级人民政府
After a famous historical and cultural town or village has been approved and announced, the local people's government at the county level shall organize the formulation of protection planning for the famous historical and cultural town or village.The formulation of protection planning shall be completed within one year after the famous historical and cultural city, town or village has been approved and announced.Article 14 The protection planning shall contain the following contents: 1.protection principles, protection contents and protection scope;2.protection measures, development intensity and construction control requirements;3.requirements for protection of traditional pattern, historical style and features;4.core protection scope and construction control belt of the famous historical and cultural block, town or village;and 5.a phased program for implementing the protection planning.Article 15 The term of the protection planning for a famous historical and cultural city or town shall be the same as that of the overall planning for the city or town;and the term of the protection planning for a famous historical and cultural village shall be the same as that of the village planning.．．．．．．
应当组织编制历史文化名镇、名村保护规划。保护规划应当自历史文化名城、名镇、名村批准公布之日起1年内编制完成。
第十四条 保护规划应当包括下列内容：
（一）保护原则、保护内容和保护范围；
（二）保护措施、开发强度和建设控制要求；
（三）传统格局和历史风貌保护要求；
（四）历史文化街区、名镇、名村的核心保护范围和建设控制地带；
（五）保护规划分期实施方案。
第十五条 历史文化名城、名镇保护规划的规划期限应当与城市、镇总体规划的规划期限相一致；历史文化名村保护规划的规划期限应当与村庄规划的规划期限
相一致。
