【abstract】in the appraisal of justice，including the expertise of medical dispute，the ciles that the party is unsatisfied with
or has demurler to the expert conclusion is very common． the law has definitive regulations for this tiles，which is the party who
has demurrer to expert conclusion and brings an accusation against it to people s court，the court shouldn t accept and hear the
case． there are objective reasons for the law regulates this kind of circs． there ale also some factors for the court to accept and
hear the case and overrule it finally． in order to avoid such things happen，it is neceary to intensify the law knowledge in the
public and reinforce the education of law theory and occupation moral among the personnel who handle the cases．

在司法鉴定中，当事人对鉴定结论不满意或者有
争议的情况非常多见。对此，一般都采取法庭质证或
者重新鉴定的方式来解决，起诉至人民法院的较少，而人民法院受理该类案件的情况更为少见。西安市某
甲区人民法院受理了这样一起案件，但最后又予以驳
回。
一、案件情况及审判结果
2002年l1月12日，西安市某单位职工赵xx被同
事王x打伤。送医院后诊断为：(1)左眼球破裂伤；(2)
左下睑板裂伤。l1月15日眼球ct示：左筛骨局限性
凹陷性骨折。2003年5月27日。西安市某大学司法鉴
定中心受该市某公安分局委托，对赵xx的伤情进行法
医学鉴定，鉴定结论为轻伤(偏重)。随后不久，案件的初审法院对这一伤害案件进行了审判，在法庭上，当
事人王x及其代理人未对鉴定结论提出任何质疑，初
审法院即按照轻伤伤害案的有关法律规定判处王x相
应刑罚。然而。案件判决后一年左右，当事人王x及其
家人却对鉴定结论产生质疑，并多次找鉴定中心理
论．而鉴定中心认为其鉴定公正合理。于是，2004年
l1月30日。当事人王×及其家人向西安市某甲区人民
法院提起民事诉讼。将鉴定中心告上法庭，其诉讼请
求有以下4项：(1)请求被告拿出其鉴定适用《人体轻
伤鉴定标准》(试行)第9条第5项(较伤前视力下降
0．3以上)的左眼依据；(2)请求被告提供对伤者(活
体)左眼不作伪盲测试鉴定的理由和依据；(3)请求依
