Marriage Property Relations
1.Estates by the Entirety
The following items of property acquired by husband and wife during the existence of marriage shall be jointly poeed:
1.1 pay and bonus;
1.2 earnings from production and operation;
1.3 earnings from intellectual property rights;
1.4 property inherited and bestowed(except the property to be in the poeion of one party as determined by will or by an agreement on gift);
1.5 other property that should be jointly owned by the couple:
1.5.1 earnings from investment of individual property;
1.5.2 housing allowance or housing accumulation fund that should acquire or has acquired by each party;
1.5.3 old-age pension or bankrupt subsidies that should acquire or has acquired by each party.2.Individual Property
The property in the following cases shall belong to one party of the couple:
2.1 the property that belongs to one party before marriage;
2.2 the payment for medical treatment or disabled living compensation arising from physical injury on one party;
2.3 the property that only belongs to one party which determined by will or gift contract;
2.4 the articles of daily specially used by one party;
2.5 other property which should be separately owned by one party.3.Property on Arrangement
The husband and the wife may conclude an agreement to determine that all or any of the property acquired during the existence of marriage or prior to marriage to be owned individually or jointly.
